Sandwich launched by demonstrator supposedly burst and created condiment mark on customs official, legal proceedings reveal
A federal customs official has testified he could sense through his protective gear the impact of a deli item thrown at him by a DC demonstrator, who has stood before a judge for assault.
Federal border agent the officer testified to the legal jury the food item "burst all over him" and he "noticed the onions and condiment" on his official attire.
No party disputes that the defendant, in his thirties, did in fact throw obscenities and a made-to-order snack at officers assigned by the administration to secure the nation's capital in the summer month.
The incident was captured on recording and spread across the internet, making the defendant a figure of opposition in Washington DC to the administration.
Government prosecutors at first tried to achieve felony charges against the defendant, but a legal panel refused to charge him.
The former president's sending of National Guard troops to the federal district this warmer months generated protest from some of the city's residents, who considered it a political use of the troops.
Based on legal filings, the defendant came near a law enforcement team at about late evening on 10 August, describing them "fascists" and shouting: "What is your purpose? Your presence is unwanted in my city!"
The court observed a re-enactment from the officer on the trial day as he gave evidence against the defendant.
"I detected it through my body armor," he said of the food's collision, noting that an onion string dangled from his official equipment and mustard discolored his clothing.
The defendant's lawyer, the defense attorney, said in her opening statement that throwing the food item was a "harmless gesture that did not, could not, cause injury".
But prosecutor the prosecutor maintained the accused must be held accountable.
"No matter who you are, you can't just go around hurling objects at people because you're upset," the attorney declared.
After the reported incident came to light, the accused was terminated from his position as a paralegal in the Department of Justice.
